Job overview
We are seeking an experienced individual for a full time, permanent Consent to Treatment Advanced Practitioner post. This is an exciting role with lots of variety and an opportunity to make a real difference to clinical practice. The Consent and Mental Capacity Department is a friendly, patient focused team (Head of Consent and Mental Capacity / three Mental Capacity Advanced Practitioners / Departmental Administrator) which supports health professionals and clinical managers in the practical application of UK law relating to consent to treatment and mental capacity.
You would have expertise in application of the law relating to consent to treatment, and relevant aspects of the Mental Capacity Act (for those who lack capacity to consent to treatment). The successful candidate will be a confident individual who is able to work autonomously and has a personal values base which is concordant with person-centred healthcare. The ability to deliver high-quality, thought-provoking training will be one of your strengths.
The team is based in Carmarthen, but some remote working can be accommodated where appropriate (Wi-Fi/internet access essential, plus proximity to Hywel Dda UHB area). It is essential to be able to travel across the Health Board area and to external meetings.
Main duties of the job
NB: This post is open to people with a relevant professional clinical qualification OR equivalent experience, qualifications and knowledge, e.g. qualifications and experience in advocacy, legal practice, etc.
You will:
- be the lead consent specialist in the team, playing a key role in improving the consent experience of patients, and having a positive impact on patient safety.
- provide health board-wide advice, support, training and expertise in the practical application of consent law to frontline health professionals.
- take forward a variety of improvement initiatives and audits which will have a positive impact on consent practice.
- ensure health board consent systems and processes are in line with national guidance and legislation, and be responsible for relevant policy development.
- represent the health board at the All Wales Consent to Treatment Group.
- participate in supportive peer supervision via Swansea University, alongside MCA and DoLS colleagues, in order to keep up-to-date with emerging legislation and caselaw.

Hywel Dda University Health Board is the planner and provider of NHS healthcare services for people in Carmarthenshire, Ceredigion, Pembrokeshire and its bordering counties. Highly specialised and tertiary services commissioned by the Welsh Health Specialised Services Committee, a joint committee representing seven health boards across Wales.

Qualifications & Knowledge
Essential criteria
- A relevant professional clinical qualification or equivalent experience, qualifications and knowledge, e.g. qualifications and experience in advocacy, legal practice, etc
- Master’s degree or equivalent relevant experience
- Excellent knowledge and understanding of legislation and caselaw relating to consent to treatment and mental capacity
- Knowledge and understanding of the healthcare environment
- Knowledge and understanding of data protection legislation
Desirable criteria
- An understanding of key processes within the hospital care pathway relating to consent to treatment
- A developed awareness and understanding of human rights caselaw
- An understanding of the role and application of the Court of Protection
- A sound appreciation of issues in relation to equality, discrimination, disability and protection of vulnerable adults
Experience
Essential criteria
- Previous experience in relation to consent to treatment and the application of the Mental Capacity Act
- Experience of working within a healthcare setting
- Extensive experience of developing and delivering training
- Clinical audit or quality improvement experience
- Track record of achievement and task completion
- Experience and competency in use of IT (including competence in using Excel, Word and PowerPoint) and patient information systems
Desirable criteria
- Practical experience working in an advisory capacity in relation to the law relating to consent to treatment, and the application of the MCA and/or human rights issues
- Experience of inter-agency working
- Project or change management experience
- Policy development experience
Language Skills

- Welsh Speaker (Level 1)
