This is an exciting opportunity to join our legal team at MTW NHS Trust at a time where we are revising our training and delivery strategy. The role reports directly to our experienced Head of Legal services who will ensure you are supported to deliver the highest standards of legal advice and advocacy for our staff, with a focus on learning and minimising any safety risks for our patients.

This post holder will oversee their own case load of complex inquests, safeguarding enquiries and claims, to include investigation, statement taking, advocacy and support to the junior members of the team in giving advice and direction in their portfolio of cases, escalating to the Head of Legal Services any  potential high risks to the Trust. 

They will support the team in any complex medico- legal enquiries and advice.

The post holder will also be required to support and deputise for the Head of Legal Services (as required)  in the delivery of a high-quality legal services training packages to the wider Trust.

The Trust’s core catchment areas are Maidstone and Tunbridge Wells and their surrounding boroughs. We work from two main clinical sites: Maidstone Hospital and Tunbridge Wells Hospital at Pembury. Tunbridge Wells Hospital opened in 2011 and provides single rooms with en-suites for all in-patients – the first of its kind in the country.

We employ more than 7,000 full and part-time staff in a huge range of clinical and non-clinical roles across both of our hospital sites.

Qualifications

  • Law Degree or equivalent relevant experience of 3 years
  • Capsticks Diploma in Risk and Claims Management or equivalent

Experience & Knowledge

  • Experience working in an Acute NHS Trust or NHS R or equivalent
  • Experience of complex inquest case management (including drafting detailed witness statements and submissions at hearing)
  • Detailed knowledge of clinical and non-clinical claims with 3 years case management experience

  • Detailed knowledge of Deprivations of Liberty Safeguards, the Mental Capacity Act, Mental Health Act and Safeguarding Legislation

Skills

  • Able to understand and manage complex information and situations with professionalism. Able to analyse and evaluate current systems and processes using appropriate tools (such as audit and surveys)
  • Able to prioritise complex work and demands
  • Demonstrable knowledge of NHS policies, Data Protection Act, Clinical Governance issues
  • Evidence of effective change management and ability to reflect on lessons learnt
  • High level of IT skills and good knowledge of all Microsoft office systems
